TERMS OF SERVICE Last updated: October 17, 2026 These Terms of Service apply to thermoshift.store, operated under the THERMOSHIFT brand (“we,” “us,” or “our”). They govern use of our website and purchases of our heat-reactive balaclavas. Our store is powered by Shopify. THERMOSHIFT is responsible for the products it sells and for its obligations to customers; using Shopify or a fulfillment supplier does not transfer those obligations away from us. Please read these Terms together with the Privacy Policy, Shipping Policy, and Returns & Refunds Policy available on our website. Nothing in these Terms removes or limits mandatory consumer rights. 1. ELIGIBILITY AND LAWFUL USE To place an order, you must have legal capacity to enter into a purchase contract under the laws applicable to you. A parent or legal guardian must place or authorize a purchase where required. You must use the website lawfully and provide accurate information. You must not introduce malicious software, attempt unauthorized access, interfere with checkout or security features, impersonate another person, or use another person’s payment details without authorization. 2. OUR PRODUCTS We sell heat-reactive balaclavas in the colors and variants described on the product pages. Please review the selected color, measurements, material information, care instructions, and other product details before ordering. A color-change demonstration illustrates the effect described for that variant under the conditions shown; it does not establish specifications or performance beyond what is expressly stated on the product page. Screen settings and lighting may affect how colors appear. This does not excuse supplying an incorrect variant, a defective product, or an item materially different from its description. Use and care for the product according to the instructions supplied. Product descriptions and demonstrations form part of the information on which customers can rely, subject to applicable law. 3. PRICES, CURRENCY, AND PAYMENT Prices are displayed in the currency identified on the store and at checkout. Product prices include applicable taxes as advertised. The total payable through checkout, including any applicable additional charges, will be shown before you place your order. Payment must be made using an accepted checkout method. Payment providers process payment information under their own applicable terms and privacy notices. Do not send full card details or passwords by email. Future price changes do not change the agreed price of an existing order. Any proposed correction affecting an order will be explained and handled in accordance with applicable law. 4. PROMOTIONS AND BUNDLES Discounts, bundles, and promotional offers apply according to the conditions displayed when you order. Any limits, eligible products, required quantities, or expiry dates must be disclosed with the offer. We do not guarantee that separate offers can be combined unless this is stated. The order confirmation records the prices and discounts applied to your purchase. Eligible discounted items remain subject to the Returns & Refunds Policy and applicable consumer rights. For partial bundle returns, any refund will reflect the discounted amount allocated to the returned item at checkout, rather than a crossed-out reference price. 5. ORDER DETAILS AND AVAILABILITY You are responsible for checking your chosen products, quantities, colors, contact information, and delivery address before submitting an order. We will send confirmation using the email address provided. Please contact zdrop004@gmail.com promptly if any order information is incorrect. If an item becomes unavailable or we cannot fulfill an order, we will notify you and refund amounts paid for the unfulfilled items. A substitute product or variant will not be supplied without your agreement. We may decline or suspend an order for a lawful reason, such as suspected unauthorized payment, fraud, or an applicable legal restriction. We will not use this discretion to unlawfully discriminate or avoid obligations relating to an accepted purchase. 6. CHANGES AND CANCELLATIONS To request a change or cancellation, email zdrop004@gmail.com as soon as possible and include your order number. We will try to make the requested change before fulfillment. Changes may no longer be operationally possible once an order has been prepared or dispatched. This does not affect any statutory cancellation or return right. If we cancel an order that cannot be fulfilled, any payment for the canceled goods will be refunded. We will not impose a penalty for a cancellation that you are entitled to make under applicable law. 7. SHIPPING AND DELIVERY We offer free worldwide standard shipping under the conditions described in our Shipping Policy. Our stated schedule is 3 business days for order preparation followed by 9 business days for shipping, for a total of 12 business days. Business days exclude weekends and relevant public holidays. Delivery information supplied when you order applies to that purchase. If an order is delayed, lost, or arrives damaged, contact us so we can investigate and provide the remedy required by applicable law. You are responsible for providing an accurate delivery address. If an address error creates a potential additional delivery cost, we will explain it before asking you to agree to that cost. These Terms do not transfer delivery risk to you earlier than applicable law permits or exclude our responsibility for a carrier or fulfillment supplier where we remain legally responsible. 8. RETURNS, REFUNDS, AND DEFECTIVE GOODS Our voluntary return policy allows you to request an eligible return within 30 calendar days after delivery. The full conditions, process, shipping costs, and refund arrangements are set out in our Returns & Refunds Policy. Change-of-mind returns under that voluntary policy generally require an unworn, unwashed, unaltered product in its original condition. Those requirements do not restrict inspection or other rights granted by applicable law. If your product is defective, damaged on arrival, incorrect, or not as described, contact zdrop004@gmail.com. We will provide the repair, replacement, refund, or other remedy required by applicable law. The 30-day voluntary return window does not replace or shorten statutory guarantee periods, complaint periods, or cancellation rights. 9. WEBSITE INFORMATION AND ERRORS We aim to keep product information, prices, availability, and delivery details accurate. If we discover an error, we will correct it and notify affected customers where appropriate. If an error materially affects an existing order, we will explain the issue and any legally available options. We will not use a general error clause to remove mandatory rights or impose a higher price without agreement. 10. CUSTOMER ACCOUNTS AND SECURITY If you use an account, keep access credentials and verification codes secure. Notify us promptly if you suspect unauthorized activity. Provide current contact information so we can communicate about your order. You are not responsible for losses caused by our failure to meet legal security obligations merely because you used the website. 11. PRIVACY Our Privacy Policy explains how information is handled when you browse, purchase, or contact us. It also explains relevant privacy choices and how to make a request. Agreement to these Terms does not, by itself, constitute consent to optional marketing, advertising cookies, or another activity requiring separate consent. 12. REVIEWS AND CUSTOMER CONTENT Reviews must reflect genuine experiences and must not contain false claims, unlawful material, confidential information, or content that infringes another person’s rights. When you submit a review for publication, you permit us to display that review for its intended purpose. You retain ownership of your content. Separate permission will be obtained for uses of photographs or other personal content where required. We may remove unlawful content, spam, or material that violates these Terms. Moderation will not be used to misrepresent genuine customer feedback. Private support messages are not automatically licensed for public advertising. 13. INTELLECTUAL PROPERTY Website content may be owned by THERMOSHIFT or used under permission from its rights holders. You may browse and retain information reasonably needed for personal shopping and keeping records of your purchase. You may not commercially reproduce or exploit protected content without permission, except where applicable law permits its use. 14. THIRD-PARTY TOOLS AND LINKS Some checkout, payment, or optional features are supplied by third parties and may have their own terms and privacy notices. External links do not mean that we control or endorse every aspect of another website. Review the relevant terms before using an external service. These provisions do not exclude our responsibility for services we use to fulfill your order where applicable law makes us responsible. 15. RESPONSIBILITY AND MANDATORY RIGHTS We will exercise the care and meet the product, service, and consumer obligations required by applicable law. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, or death or personal injury caused by negligence where applicable law prohibits exclusion. Nothing excludes mandatory rights concerning product quality, conformity, delivery, refunds, guarantees, or compensation. Products are not sold without those protections merely because they were purchased online. Any lawful limitation must be read narrowly and consistently with the rights that apply to your purchase. 16. ACCESS RESTRICTIONS We may reasonably restrict website access in response to fraud, security threats, or a serious breach of these Terms. Where appropriate, we will give notice and an opportunity to resolve the issue. Restricting access does not erase an existing order, refund obligation, privacy right, or other accrued legal right. 17. GOVERNING LAW AND DISPUTES These Terms are governed by the applicable laws of Mexico, subject to mandatory consumer protections that apply to you. Where the law of your place of residence provides protections that cannot be waived by choosing another law, those protections remain available. Nothing in these Terms requires you to waive a competent consumer authority, a legally available court, or another mandatory remedy. The updated version will show a new date. Material changes will be communicated where required. An update will not retroactively remove rights or change the agreed conditions of an existing purchase without a valid legal basis and any necessary agreement. If a provision is unenforceable, the remainder continues only to the extent permitted by law. Nothing here excludes reliance on binding pre-contract information or requires an ambiguity to be interpreted against the consumer. 19.
